New Amendment: Law No. 41 of 2024 concerning personal status, which will be implemented as of April 15, 2025:

Supervisor Judge’s Power:

 

Pursuant to section (8) of the new Personal Status Law (the “New Law”), the supervisor judge, and before presenting the case to the competent court, may decide to present the parties to the case to the Family Guidance Committee to resolve the dispute between them through friendly means if he sees that it is useful.

According to this new amendment, the supervisor judge shall have the power to refer parties of the case to the Family Guidance Committee if it is established to him that the dispute may be solved through amicable means.

There is no doubt that this authority of the supervising judge will reduce the duration of litigation and limit the disputes between the parties, which will lead to their resolution in a short time, which will have a positive impact and reduce the pressure of lawsuits on the courts.

To summarize, In our opinion this step aims to reduce the length of litigation in personal status matters and gives the parties to the dispute an opportunity to resolve any disputes arising between them amicably through an agreement documented by the competent judge and having the force of an enforceable instrument.

Controversial issues that cannot be resolved amicably are referred to the court for resolution pursuant to final judicial rulings. The parties to the dispute have the right to appeal these rulings through the established procedures.
